Terms Of Service

All customers are required to read and agree to the Terms of Service before any service takes place. By accepting the work order customer agrees to the entire Alternis, Inc’s Terms of Services.

1 – GENERAL

Alternis IT and its authorized designee (Alternis IT) will provide products and services described on the front of this Work Order (the Services) using technicians (Technicians). For purposes of this Work Order, You and Your shall refer to you as the purchaser of the Products and Services and owner of the computer and peripherals to be serviced. This Work Order shall collectively constitute the entire contract relating to the Services.

2 – SCHEDULING SERVICE

A Alternis IT associated or Technician will schedule Your in-home/office or Pickup Service. A Alternis IT associated will typically call to confirm the scheduled time window for the Services. Services will usually be performed during customary work hours Monday through Sunday. You may request expedited service or service outside of these standard hours, subject to additional charges as indicated on the front of this Work Order. Alternis IT will not be responsible for delays or failure in performing such Services caused by acts of nature, acts of any government, failure of transportation, accidents, riots, wars, terrorist threat or action, work stoppages or strikes, or, in general, other causes beyond Alternis IT’s control. Also, Alternis IT will not be responsible for delays or failure to perform Services due to conditions affecting the computer(s) to be serviced prior to arrival by the Technician. A Technician will attempt to notify you using the contact information You provided if the Services will not be completed at the promised date and time or if the Services cannot be performed for any reason.

3 – YOUR REQUIREMENTS, OBLIGATIONS, AND RESPONSIBILITIES FOR SERVICE

You agree to the following as a condition to Products, Service and Services:

A. At the time that the Technician arrives at your home or office, please have all hardware specifications available. The Technician will confirm that You have the appropriate hardware and software required for the Services.

B. An adult (at least 18 years of age) authorized to approve the Services must be present continuously during the performance of the Services.

C. The Technician must have access to the computer and/or peripherals subject to the Services, and access to install wires/connections and the operating system as necessary.

D. You agree to provide, promise and assure a non-threatening and safe environment for the Technician’s performance of the Services.

E. It is Your responsibility to make back-ups of all software and data stored on any computer hardware prior to provisions of Service, and to remove all media from any computer. Neither Alternis IT nor any of their Technicians, Associates or Contractors shall be responsible at any time for any loss, alterations or corruptions of any software, data or media.

F. You represent and warrant that You are the owner of the computer(s) to be serviced, and You have current, valid licenses or otherwise have sufficient rights to all software resent and warrant that you have the appropriate subscriptions with Internet Service Providers (ISP).

G. You must report any physical damage (i.e. dents and scratches) to Your product(s) at time of Service or you waive all claims.

H. If a Alternis IT Technician arrives at the scheduled Service time and no adult is present, or if the Technician determines that he/she does not reasonably have access, cooperation or safe working area, Alternis IT may cancel the Service and an $80.00 (for residential) or $125.00 (for business) cancellation charge will be assessed.

I. You will not use any of Alternis IT’s services or resources for illegal activities. Alternis IT is obligated by law and will notify and cooperate with the appropriate authorities if illegal products or activities are discovered or suspicious requests are made.

4 – YOUR REQUIREMENTS FOR NETWORKING SERVICE

You agree to the following minimum system requirements:

  • All computers connected to the network must have a minimum Operating System of Windows XP or higher, 10MB of hard drive space available and 32MB of available memory with a minimum of 256MB total. The minimum CPU speed must be 900 MHz or higher.
  • All passwords for the operating system and/or ISP must be available to the Technician at time of service.
  • Operating system Disk, Restore CD or currently installed Operating System CD along with the Key Codes must be available to the Technician at time of service.
  • All computers to be networked must be virus free and all peripherals connected must be in good working condition.
  • Broadband Connections (Cable Modem or DSL Modem)“ The Broadband service must be installed and in operation prior to the Technician’s arrival for networking services, unless noted in advanced. This includes connections form the modem to the main computer.
  • Satellite-delivered Internet services are ineligible for this service.

5 – LIMITATIONS OF SERVICE ALTERATIONS TO PROPERTY

Certain networking Services may require drilling holes in walls, securing wiring to baseboards and similar alterations to the property. Alternis IT is not responsible for any property damage relating to the incidental alterations necessary to provide the Services. Wiring or other connections between computers or peripherals may be limited by wall access, building construction and physical proximity. Rented or leased residences are limited to wireless networking solutions without the written consent from the property owner/management. Buildings with flat roofs or slab houses may be limited to same-room wired networking or must be wireless. All wiring will typically be room to room through walls or along baseboards as is reasonably possible and the Technician shall make reasonable efforts to conceal wiring. Alternis IT does not make any representations or warranties regarding the resulting configuration or concealment of any wiring.

6 – CONFIDENTIALITY OF INFORMATION

You acknowledge and agree that in the course of providing You Services our Technician may access files, information and/or other data on Your computer(s) or other product(s). Alternis IT Technicians agree to use reasonable efforts to keep all personal data and information on Your computer(s) confidential; however, You acknowledge and agree that neither Alternis IT nor any of its Associates, Technicians or Contractors warrant or otherwise guarantee the confidentiality of any such personal data and information on Your computer(s) or other product(s).

7 – WARRANTIES; LIMITATIONS OF LIABILITY

A. Subject to these Terms of Service, Alternis IT warrants that the Services were performed in a good and workmanlike manner and will be free from material defects in workmanship for the period commencing at 12:01 a.m. on the date the Services were completed and ending at 12:01 a.m. fourteen (14) days thereafter. No warranty is made hereunder for the hardware or software associated with the Services.

B. No other warranties, expressed or implied, are made hereunder relating to the Services.

C. To the extent permitted by applicable law, the liability for Alternis IT and the Technicians shall be limited to the total service fee paid to Alternis IT for the Services.

D. IN NO EVENT WILL Alternis IT OR ITS TECHNICIANS, ASSOCIATES, CONTRACTORS OR AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR RELIANCE DAMAGES WHICH INCLUDE, BUT ARE NOT LIMITED TO, ANY DELAY IN RENDERING SERVICE, LOSS OF DATA, LOSS OF USE, PUNITIVE DAMAGES, LOSS OF PROFITS, OR COMMERCIAL LOSS.

E. Alternis IT, its technicians, associates, contractors or affiliates do not warranty uncompleted work. Subsequent work is subjected to standard rates.

F. All product sales are final.

G. All warranty issues must be handled directly with the manufacturer. Alternis IT is not responsible for product failure and does not warrant any products.

8 – CANCELLATION/REFUNDS

Services are non-refundable after they are performed. All product sales are final. Manufacturers warranties may apply.

9 – RESERVATIONS

Alternis IT reserves the right to refuse or cancel services at anytime for any reason.

10 – GOVERNING LAW

Unless otherwise governed by applicable state law, this Work Order (Contract) shall be interpreted and enforced in accordance with the laws of the Commonwealth of all US States.

11 – CONTRACT PROVISIONS

If there is a conflict between this Contract and information communicated either orally or in writing by Alternis IT, an Associate, Technician or contractor, the provisions of this Contract shall control. No one has the authority to change or modify the Contract without proper written approval by Alternis IT.

12 – SEVERABILITY

In the event that any portion of this Contract is held to be unenforceable, the unenforceable provision shall be construed in accordance with applicable laws as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

13 – SOFTWARE CHARGES

In addition to normal rates, Alternis IT reserves the right to charge for installing software. All software installed by Alternis IT technicians do not includes technical support. Training is not included and will accrue normal charges.

14 – PAYMENTS

All customers are welcomed to make payments with Cash, Personal or Business Checks and major Credit Cards. Checks must be made to Alternis IT. To make payment with major Credit Cards a working internet connection is required at the time of payment. There is a $25 fee for returned checks; and if full payment is not received by the due date as indicated on the Work Order or Invoice, the higher of $30 or 10% penalty will be added to the total amount, and every 30 days there after. In addition, Alternis IT may enlist the help of collection agencies and/or report the debt to the credit bureaus. The accrued costs of enrollment of such services to collect will also be billed directly to You, the customer.

15 – CUSTOMER PRODUCTS IN POSSESSION OF ALTERNIS IT

Customers are required to pickup products within 15 days of notification to pickup. Products left beyond 15 days will be considered abandoned and will become the property of Alternis IT. Alternis IT reserves the right to recycle, resell, reuse or destroy abandoned products.

16 – CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
